For example, on American Idol, the contestants have to pick from a list of cleared songs that artists approved to be on TV. They can't just pick or broadcast anything they want.

If someone that heard that song went and bought the album, more exposure for them. The more money they make. It's not like they're still relevant. If their sales increase because of it being played and they actually make some money, then I hope they apologize for causing all this rukus. Plus, it's true. She is a barracuda and I love that about her.

That said I don't like the song so I'd be happy if they drop it. Not true at all. There is a famous case that says if you own a public swimming pool and you play an artists song at the pool, you can be sued for an ASCAP or BMI infringement if you don't pay royalites. Anytime music is played publically, royalites must be paid. Even if you have a business and when a customer is on the phone on hold and you have music playing from the radio, this violates the rules of ASCAP and BMI. I have been involved in lawsuits where my clients have been sued by ASCAP and BMI, and have represented bar owners who have played a radio in their bar, have been asked to pay royalties several times, and refused. They were sued in federal court. It was me and my partner, against all these New York corporate attorney's. After two days of trial, we settled. lol Edited By: drp4video 09/05/2008 11:42 PM.
