And I will say it again. Just because you didn't blow (or in this case do the blood test) over the legal limit does not mean you weren't influenced by
what you drank. That is why it is called a DUI.

Yeah like someone above said you can be below the legal limit and still get a DUI. Just think a person who has never drank before. They may be below the legal
limit but still in no shape to drive.

I'm under the impression you should never do blood. The PBT is never accurate. And, for the most part, it will always underestimate your BAC. However, if
you do blood, that's set in stone and there's no arguing that.
With that said, even if you are under the legal limit, if the officer wanted to and could articulate it, he could say that it didn't matter, your driving was still impaired and you were a threat to yourself and society. Just because a legal limit exists does not mean you can drink anything under that limit. Just because one person is technically "drunk" at .08, doesn't mean someone else isn't technically "drunk" at a .04. In either case, I'm sorry that happened to you. All it can be now is a lesson learned. |

I would never open myself up to this on JJB because I don't think there is a more judgemental place.
It sounds like you are mad at the friend though and I don't understand that. You made the choice to drive, there were other options and you didn't take that route. With a .029 hopefully they will let you go without a bunch of BS. That is pretty low and I don't think you would be impaired with a level like that. Good luck, I know you have probably put alot of hard work into your license. |
