I finally received my deposit back after I moved out of my apartment that I was living in with my ex. Unfortunately the check is in both our names to which my
ex said I could have the deposit back but will I be able to deposit the check into my bank acct if his name is on it or even cash it?

If the check is written out to both of you using the word AND, then he would have to be with you to cash the check. If you want to deposit the check, it has to
go into an account with both of your names on it, unless he is with you during the transaction. If it has an OR, then you could cash it without him being with
you.

it has the & symbol which im tempted to change to word OR which is easy from the way he wrote it but im too scared id get in trouble!

Yeah, I work at a bank and if we notice any alteration to the check, we will not accept it. Having the & symbol means he will have to be with you. If he
has already "okay'd" for you to have the money, then he probably won't have a problem meeting you at the bank one day to do a quick
transaction.

We aren't on speaking terms, that's the problem. He didn't even leave a forwarding address to the landlord when he left. just my luck, a nice check
with my name on it and I can't even cash it.
