To answer the original question. I would think the child needs to be living with you and no one else can claim the child as a dependent.
Like let's say your boyfriend and his 3 year old son live with you. he doesn't work but you do. You can claim both as your dependents. |

Just wanted to add that you'd be best talking to an accountant. If you are in an honest situation and honestly want to know, call the IRS...they have numbers where you can call to ask any questions without penalty.

A friend of mine did this because she was supporting her nieces and nephews. She was audited and ended having to pay back the taxes she received over the next few years. The IRS just took it from her future tax returns because the children were not legally hers.
I don't know if that would happen in all cases, but there ya go. |
